According to the complaint, this behaviour by the police, which was observed during operations to combat the theft of electricity in Roma settlements, constitutes a clear targeting of the Greek Roma community and violates the right of all citizens to a fair trial, as enshrined in Article 6 of the European Convention on Human Rights (ECHR). It also violates Article 8 of the Constitution, which guarantees the right to a legal judge, as well as Article 20 (1) which guarantees the right to legal protection. Discrimination against individuals or population groups on the basis of nationality, religion, colour, sexual orientation or any other characteristic is prohibited by the Constitution itself, Article 4 of which guarantees the equality of all citizens.
