05 • 03 • 2023

On 16 February 2023, the Court of Justice of the European Union found that Greece had systematically violated Directive 2008/50/EC on the maximum levels of nitrogen dioxide in the Athens area.

On 16 February 2023, the Court of Justice of the EU found that Greece has for many years been violating EU Directives over air pollution in Athens. Specifically the ruling detailed that the Greek state violated Directive 2008/50/EC on ambient air quality and cleaner air for Europe:

What is the problem with the rule of law?

As an EU member state, Greece must comply with the EU treaties and EU law. However, in this case the country has systematically breached Directive 2008/50/EC on ambient air quality, with the result that air pollution in the capital systematically exceeds the limits set out in EU law. Furthermore, the country has failed to adopt measures to reverse this trend, as per its obligations.
