On 16 February 2023, the Court of Justice of the EU found that Greece has for many years been violating EU Directives over air pollution in Athens. Specifically the ruling detailed that the Greek state violated Directive 2008/50/EC on ambient air quality and cleaner air for Europe:
-Firstly, it has consistently and systematically exceeded the maximum limits set by the above-mentioned Directive for nitrogen dioxide levels in the Athens area between 2010 and 2020.
-Secondly, it failed to adopt appropriate measures to reduce nitrogen dioxide levels to the prescribed annual limits, which means that the country failed to comply with its obligation to ensure that national air quality plans provide for appropriate measures to ensure that the ceilings are not exceeded for long periods of time.
As an EU member state, Greece must comply with the EU treaties and EU law. However, in this case the country has systematically breached Directive 2008/50/EC on ambient air quality, with the result that air pollution in the capital systematically exceeds the limits set out in EU law. Furthermore, the country has failed to adopt measures to reverse this trend, as per its obligations.
