The European Commission sent a reasoned opinion to Greece in the context of infringement proceedings under Article 258 of the Treaty on the Functioning of the European Union, due to the incomplete integration in the Greek legal order of the new EU rules on waste flows.

Where is the problem with the rule of law?

The application of EU law is an obligation of the Member States of the European Union. If possible breaches of EU law are detected, the European Commission may take a series of actions against that Member State to ensure the correct and full application of EU law by initiating infringement proceedings in accordance with Articles 258 and 260 of the TFEU.

In this case, the European Commission sent a reasoned opinion to Greece calling on it to align its national legislation with the provisions of Directive (EU) 2018/849 because, in the opinion of the European Commission, Greece has not fully transposed into its national legislation the new rules on waste flows, in violation of EU law.
