Partial transposition of the Directive on procedural safeguards for children in criminal proceedings – infringement: INFR(2019)0191
Each Member State of the European Union must fully apply EU law. The body responsible for identifying possible violations of EU law is the European Commission. Where a Member State does not apply EU law and breaches its obligations under the EU Treaties, the European Commission may open a formal infringement procedure under Articles 258 and 260 TFEU (see details on the infringement procedure here).
Directive (EU) 2016/800 (on procedural safeguards for children suspected or accused in criminal proceedings), as part of the overall EU strategy to ensure common minimum standards on the rights of suspects and accused persons to a fair trial, establishes common minimum standards on the rights of children suspected or accused in criminal proceedings or subject to a European Arrest Warrant procedure.
As mentioned in the “November infringements bundle: main decisions 16-11-2023” Greece is among the countries that have not fully transposed the above mentioned Directive (EU) 2016/800 into their national law, as the Commission considered that the country had not transposed the requirements of the Directive on special treatment in case of deprivation of liberty .It therefore decided to send a supplementary letter of formal notice to Greece, inviting it to take the necessary measures to address the identified shortcomings.

The application of EU law is an obligation of the Member States of the European Union. If infringements of EU law are identified, the European Commission may take a series of actions against the Member State concerned to ensure the correct and full application of EU law by opening infringement proceedings under Articles 258 and 260 TFEU.
Αν εντοπισθούν πιθανές παραβιάσεις του Δικαίου της ΕΕ, η Ευρωπαϊκή Επιτροπή δύναται να προχωρήσει σε μία σειρά ενεργειών κατά του συγκεκριμένου κράτους μέλους, ούτως ώστε να διασφαλιστεί η ορθή και πλήρης εφαρμογή του ενωσιακού δικαίου, εκκινώντας διαδικασία επί παραβάσει σύμφωνα με τα άρθρα 258 και 260 της ΣΛΕΕ.
In November 2023, the European Commission decided to send a supplementary letter of formal notice to Greece, due to its failure to fully transpose Directive (EU) 2016/800 on procedural safeguards for children suspected or accused in criminal proceedings.
