On 25-10-2022, a lawyers’ union reported that a lawyer and a member of the Union was verbally assaulted by a police officer and subsequently detained at the Exarchia Police Station on unsubstantiated charges.

Where is the problem with the rule of law?

In a state governed by the rule of law, the police authorities must be governed by certain principles, including the principle of legality, the principle of proportionality, the prohibition of the abuse of police power, and respect for and protection of human rights.

The powers of the police authorities and the conduct to be displayed in the performance of their duties are regulated, inter alia, by Decree 141/1991 and Decree 254/2004. Any arbitrary/abusive exercise of the powers given to the police in the context of the exercise of (lawful) state force is a dangerous phenomenon for a democracy.

Lawyers are collaborators in the administration of justice and are legally entitled to enjoy the respect and honour due to their profession from any person acting on behalf of the public administration.

In this particular case, however, a complaint alleges that a lawyer was verbally attacked by a police officer without reason, and when he asked for an explanation for this behaviour, was taken to the Police Station on unsubstantiated charges.
