Failure of Greece to ensure that operational entities comply with Regulation (EU)2021/116 – Infringement: INFR(2023)2051
Each Member State of the European Union must fully apply EU law. The body responsible for identifying possible violations of EU law is the European Commission.
Where a Member State does not apply EU law and breaches its obligations under the EU Treaties, the European Commission may open a formal infringement procedure under Articles 258 and 260 TFEU (see details on the infringement procedure here).
Implementing Regulation (EU)2021/116 concerns the definition of the Common Project One supporting the implementation of the European Air Traffic Management Master Plan. The project ensures the synchronised implementation of different procedures and technical solutions, which is essential for the good management of air traffic throughout the Single European Sky network. According to the “July infringements package”, Greece is among the countries that have yet to implement some of the procedures foreseen in the above-mentioned implementing regulation.
The deadline for implementation was set at 31 December 2022. In particular, the Commission sent a letter of formal notice as it considered that Greece has not ensured that its operational stakeholders comply with the requirements of the Common Project One Regulation.

The application of EU law is an obligation of the Member States of the European Union. If infringements of EU law are identified, the European Commission may take a series of actions against the Member State concerned to ensure the correct and full application of EU law by opening infringement proceedings under Articles 258 and 260 TFEU.
Greece must respond to the Commission’s arguments and remedy the deficiencies within two months. Otherwise, the Commission may decide to send a reasoned opinion.
Στη συγκεκριμένη περίπτωση η Επιτροπή προχώρησε σε αποστολή προειδοποιητικής επιστολής προς την Ελλάδα λόγω του ότι δεν έχει διασφαλίσει τη συμμόρφωση των επιχειρησιακών ενδιαφερόμενων φορέων της με τις απαιτήσεις του εκτελεστικού κανονισμού (ΕΕ)2021/116 για τον καθορισμό του πρώτου κοινού έργου το οποίο στηρίζει την εφαρμογή του ευρωπαϊκού γενικού προγράμματος διαχείρισης της εναέριας κυκλοφορίας.
Η Ελλάδα οφείλει να απαντήσει στα επιχειρήματα της Επιτροπής και να διορθώσει τις σχετικές ελλείψεις εντός δύο μηνών. Διαφορετικά, η Επιτροπή μπορεί να αποφασίσει να αποστείλει αιτιολογημένη γνώμη.
