Incorrect transposition and application of provisions of the Directive on seasonal workers – infringement: INFR(2023)2021
Each Member State of the European Union must fully apply EU law. The body responsible for identifying possible violations of EU law is the European Commission.
Where a Member State does not apply EU law and breaches its obligations under the EU Treaties, the European Commission may open a formal infringement procedure under Articles 258 and 260 TFEU (see details on the infringement procedure here).
Directive 2014/36/EU sets out the conditions of entry and residence of third-country nationals for the purpose of seasonal work. The Directive aims to ensure fair and transparent rules for the admission of seasonal workers from third countries to the EU. It also aims to provide decent working and living conditions, equal rights and adequate protection against exploitation. As mentioned in the “April infringement package“, ensuring full compliance with the Directive on seasonal workers is an important prerequisite for attracting the necessary seasonal workforce to the EU and a potential factor in reducing irregular immigration.
Considering that Greece, among other Member States, has transposed and/or incorrectly implemented certain obligations under the Directive, the Commission decided in April 2023 to open an infringement procedure by sending a letter of formal notice to Greece. Greece now has two months to respond to the Commission’s arguments. Otherwise, the Commission may send a reasoned opinion to Greece.

The application of EU law is an obligation of the Member States of the European Union.
If possible breaches of EU law are identified, the European Commission can take a series of actions against the Member State concerned to ensure that EU law is correctly and fully applied by launching infringement proceedings under Articles 258 and 260 TFEU.
In this particular case, the Commission sent a letter of formal notice due to the incorrect transposition and/or implementation of the provisions of Directive 2014/36/EU on seasonal workers.
